You Can Stop Foreclosure
Many individuals in Florida don’t understand that they can stop the foreclosure of their home even if they are no longer making mortgage payments. Recently, there have been a number of foreclosure cases that have been filed incorrectly and a lawyer that has experience can help you defend your foreclosure case. An improper foreclosure could resort from the actions of a lender, omissions or other factors. Because of this, you may be able to cease making mortgage payments and keep your home while your case goes through the court system.
Be aware that this does not mean that you will not have to pay the mortgage loan back or that you will stop the foreclosure completely. However, stopping the foreclosure of your home is possible if the lender or bank has violated the Florida Unfair Lending act or other unethical lending practices. If a bank or lender is found to be in violation, the whole among of the mortgage has to be waived and mortgage can be voided. Even if this is not relevant to your case, a good defense attorney can at least buy you some time so you can negotiate with the bank, sell your home at a good price, refinance your home, apply for a repayment plan or file for bankruptcy.
When the owner of a home is facing foreclosure they become distressed and they don’t know what they should do. Selling the house may not be the answer because most likely there is no equity left in the home.
So should a homeowner fight foreclosure? There is a big misconception that hiring a lawyer would not be cost effective. The logic is that if the homeowner cannot afford their mortgage, how they can possibly hire a good lawyer? First of all, everyone is capable of hiring an attorney and should hire one to represent them in a foreclosure case. There are a lot of lawyers that now specialize in foreclosures because of the growing number of foreclosures. There are now many “expert” foreclosure lawyers. Because the facts in the majority of these cases are the same, there are many good lawyers that have experience and can offer very affordable payment arrangements. Many people do not know that when the foreclosure process has begun, the bank will not accept any more mortgage payments because if they do, this will negatively affect their ability to foreclose on the home.
Also, the bank will pay any taxes and insurance on the home. Therefore when the bank files for foreclosure, the majority of the expenses of the homeowner are paid for by the bank. These expenses include the taxes, insurance and mortgage. Even so, being the legal owner of the home, you still have right to the home and this includes remaining in the home, collecting rent, and any other thing associated with home ownership. You can save or build equity in the home if you fight the home foreclosure for a year or longer. The money you spend on a qualified attorney is a small price to pay compared to the overhead your receive by being the owner of the home.
