There was one judge that found that a lawyer was filing many cases that were not being serviced in the right way. This may mean that the one perpetrating the scam is sending off bankruptcy papers to a lawyer to file without the homeowners knowledge. Those who are perpetrating the scam use this method to keep from violating the portion of the bankruptcy code that has restrictions on those that prepare bankruptcy petitions.
Lenders are also capable of flagging possible foreclosure scams because they have specific access to the necessary documents. A lender will receive all of the bankruptcy sheets on a certain property. The documents the lender see may show that various debtors are linked to one property. The lender is in a special position to put together this information.
Bankruptcy lawyers may also be able to expose foreclosure scams. The owner of a home whose bankruptcy petition is filed by someone running a scam can have their case dismissed because of a lack of participation and they can re-file for bankruptcy. A homeowner may reveal to the bankruptcy lawyer that they have been the victim of a foreclosure scam.
Debt counselors should know that perpetrators of scams sometimes seek out lawyers with little experience and without an established reputation when it comes to handling bankruptcy cases. Many times the lawyer is supposed to give part of their legal fee to the one perpetrating the scam in exchange for being referred by them.
